The Official Rules
1. Eligibility: To be eligible, entrants must be at least 18 years of age at time of entry, and a legal resident of the District of Columbia or any one of the 50 United States. Employees of Tango Media and its affiliates, Sponsors, marketing partners and immediate families and household members of each are not eligible. Void where prohibited by law.
2. To Enter: Complete the Official Entry Form at http://tangopublishing.com/tangotogether/cambridge-beaches/. Only one entry per person or email address. Entries by mail, by fax or by any other means will be disqualified. There is no purchase necessary to enter or win. Deadline: Entries must be received by 11:59 p.m. EST on 12/31/07. Incomplete and/or inaccurate entries will be disqualified. Entrants subject to all notices posted online including but not limited to privacy policy. Winner will be randomly selected by Tango Media on or before 1/08/08. Winner will be notified by Tango Media via email or mail at address given on entry form no later than 1/15/08. 3. Prizes: Winner will receive products and services from our Sponsors totaling over $XXXX.XX in Approximate Retail Value. Taxes on prizes are the sole responsibility of the winner. No substitution of prizes is permitted, except by Sponsors.
Sponsors reserve the right to add or withdraw prizes, substituting with equal value, for any reason. Winner must provide Sponsors with a valid shipping address and shall accept all prizes awarded by 2/14/08.
4. Affidavit of Eligibility/Liability and Publicity Release: Winner must execute and return an Affidavit of Eligibility/Liability and Publicity Release within 7 days of issuance thereof. Failure to properly and/or timely execute and return such forms and/or failure to comply with any portion of the Official Rules may result in disqualification and the prize being awarded to an alternate Winner. Prizes are non-transferable except where indicated. Only Winner will be notified. The Affidavit of Eligibility/Liability and Publicity Release will require the Winner to: (a) consent to Tango’s and Sponsors’ use of Winner’s name, likeness, opinions, hometown and state for promotional purposes in any media without further payment or consideration; and (b) release and hold harmless Tango Media, Cambridge Beaches and all prize suppliers, their respective parents, subsidiaries, affiliates, divisions, advertising, and promotional agencies, and each of their respective directors, officers, employees and agents (collectively “Releasees”) from and against any and all claims, actions, and liability for any injury, losses, damages, disputes, disability and/or death resulting from participation in this Sweepstakes and/or acceptance of any prize (including, without limitation, any travel or activity in connection therewith).
5. Liability: Tango Media assumes all responsibility for administration of the entire program including drawing, rules, regulations and prize distribution. Tango Media assumes no responsibility for entries not processed due to network, hardware, or technical failures. Automated entry devices or other conduct that impedes the integrity of Sweepstakes is prohibited. If cancelled, Tango Media reserves the right to award prizes to eligible, non-suspect entries received prior to action requiring cancellation. In the event of a dispute, entry will be deemed made by authorized holder of email address associated with entry. Tango Media reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of this sweepstakes or to be acting in violation of these Official Rules in a disruptive manner. Any attempt by any person to deliberately damage Tango Media’s Web site or undermine the legitimate operation of this Sweepstakes may be a violation of criminal and civil laws and, should such an attempt be made, Tango Media reserves the right to seek damages from any such person to the fullest extent permitted by law.
Tango Media’s failure to enforce any provision of these Official Rules shall not constitute a waiver of that provision.
6. Disputes. Entrant agrees that: (1) in the event of any dispute or claim arising out of or connected with this Sweepstakes, the entrant and Tango Media shall make a good faith effort to resolve that dispute or claim through mediation facilitated by a neutral third party, the cost of which shall be borne by Tango Media; (2) in the event that the parties are unable to reach a resolution through mediation, the parties select the State and Federal Courts located in the State of New York, County of New York as the exclusive forum in which the matter may be litigated; (3) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys’ fees; and (4) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased, where applicable. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant, Sponsors and Promoters in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New York, U.S.A. without giving effect to any choice of law or conflict of law rules (whether of the State of New York, U.S.A. or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York, U.S.A. All federal, state, and local laws and regulations apply.
7. Data Collection. Tango Media collects certain personal information from you when you enter the Sweepstakes. The information collected is subject to the Tango Media Privacy Policy (http://www.tangomag.com/Website-Privacy-Policy.htm).
8. Winner Request/Official Rules. For Winner’s name and/or a set of Official Rules, send a self-addressed, stamped envelope to Tango Media, 236 W. 27th Street, 8th floor, New York, NY 10001. Requests for Winner’s name and/or rules must be received by 1/31/08.
